Welcome to Noorns NuGen! We want you to feel confident using our services. These Terms & Conditions (“Terms”) explain what you can expect from us and what we expect from you. By creating an account, purchasing a report, or using our services, you agree to these Terms.

1. Who We Are

Noorns NuGen (“Noorns,” “we,” “us,” or “our”) provides privacy‑first nutrigenomics software and personalized digital reports.

2. What We Do

Noorns analyzes your raw DNA file locally in your browser to generate personalized nutrition‑ and lifestyle‑focused reports.
– We do not upload, store, or access your genetic data.
– Reports are educational and informational only. They are not medical advice, diagnosis, or treatment. Always consult a qualified clinician before changing diet, supplements, or medications.

3. Eligibility & Accounts

  • You must be at least 16 years old to use the Services in the EU. If you are under 16, a parent or legal guardian must consent.

     

  • You must provide accurate account information and keep your login credentials secure.

     

  • We may suspend or close accounts that violate these Terms or applicable law.

4. Acceptable Use

When using Noorns, you agree not to:
– Interfere with or disrupt our Services.
– Attempt to access systems or data you are not authorized to.
– Share, resell, or publicly post purchased reports (except with your personal healthcare professional).
– Use our Services for unlawful, deceptive, or harmful purposes.

5. Health & Science Disclaimer

  • Our Services are not a medical device and do not replace professional medical advice.

     

  • Genetic insights are probabilistic and evolving; results may not apply to everyone.

     

  • Always seek professional guidance, especially if you are pregnant, nursing, managing a condition, or taking medication.

     

  • In an emergency, call your local emergency number immediately.

6. Purchases, Pricing & Taxes

  • Prices are shown at checkout and may change from time to time.

     

  • Payments are processed securely by trusted third‑party providers (e.g., Stripe, PayPal). We do not store full card details.

     

  • Taxes (VAT/Btw) will be shown at checkout where applicable.

7. Your License to Use Reports

When you purchase a report, you receive a personal, non‑exclusive, non‑transferable license to use it for your own non‑commercial purposes.
– Save your report — we cannot recreate it for you since we never see or store your DNA data.
– You may share your report with your healthcare professional. Wider sharing or resale is not permitted without our consent.

8. EU Right of Withdrawal (Cooling‑Off)

Under EU/EEA law, you normally have a 14‑day right to withdraw from online purchases.
– For digital content like our reports, the right of withdrawal does not apply once generation begins if you consent to immediate delivery and acknowledge you lose this right.
– At checkout, we will clearly ask you to confirm this. If you do not consent, you may wait until the cooling‑off period ends before generating your report.

10. Privacy & Data Protection

  • DNA data is processed only in your browser. It never reaches our servers.

     

  • Our [Privacy Policy] explains what account, payment, and support data we do process, and your GDPR rights.

     

  • Do not email or send us your raw DNA file.

11. Security

We use industry‑standard security (TLS encryption, access controls). If you believe you’ve found a vulnerability, please contact security@noorns.com.

Our Services may reference third‑party tools (payment processors, labs, supplement vendors). We are not responsible for their practices or content.

13. Intellectual Property

  • All Noorns content, software, and branding are protected by intellectual property laws.

     

  • Purchasing a report does not give you ownership of our software or database.

     

  • By submitting feedback, you grant us the right to use it without restriction.

14. Warranties & Liability

  • Services are provided “as is” and “as available,” to the maximum extent permitted by law.

     

  • We do not guarantee uninterrupted or error‑free operation.

     

  • We are not liable for indirect or consequential damages.

     

  • Our total liability for claims will not exceed the amount you paid us in the 12 months before the claim.

     

  • Nothing in these Terms excludes liability where it would be unlawful to do so (e.g., fraud, death, or injury caused by negligence).

15. Termination

We may suspend or terminate your account if you breach these Terms, engage in fraud, or create risks for others. You may stop using our Services at any time. Sections on intellectual property, disclaimers, and liability limits will continue to apply.

16. Changes to Terms

We may update these Terms from time to time. If changes materially affect your rights, we will notify you (e.g., by email or in‑app) before they take effect. Continued use of the Services after the effective date means you accept the new Terms.

17. Governing Law & Disputes

  • These Terms are governed by the laws of the Netherlands.

     

  • If you are an EU/EEA/UK consumer, you also benefit from mandatory protections in your country of residence.
